PRIVACY POLICY

1. General Provisions

1.1. This Privacy Policy (hereinafter – the "Policy") has been developed by WebCode.Agency (hereinafter – the "Company", "WebCode.Agency") in accordance with the applicable legislation of Ukraine, including but not limited to the Law of Ukraine "On Personal Data Protection" of June 1, 2010 No. 2297-VI, as well as the principles and rules of the General Data Protection Regulation (GDPR) of the European Union. This Policy defines the procedure for obtaining, collecting, accumulating, storing, processing, using, protecting and disclosing personal data (hereinafter – the "Data") through the website: https://webcode.agency and/or related services/tools (hereinafter – the "Resources") and applies to all information that the Company may obtain about the User (hereinafter – the "User") in the course of using the Resources.

1.2. By using the Resources, the User provides explicit and unconditional consent to the use of their personal data submitted to the Company and/or its Partners. If the User does not agree with the terms of this Policy, they must refrain from using the Resources.

1.3. This Policy applies solely to the Company's Resources and does not regulate third-party websites to which the User may be redirected via links available on the Resources.

1.4. "Data" means any information that directly or indirectly relates to a particular User, including but not limited to: first name, last name, email address, phone number, region of residence, information about User's activities on the Resources, messages exchanged with other Users or the Administration, as well as any other information voluntarily provided by the User.

1.5. Processing of Data shall mean any operations performed with such Data, including but not limited to: collection, recording, accumulation, storage, systematization, transfer, clarification, updating, modification, blocking, deletion, dissemination, provision of access, anonymization, and other methods of use.

1.6. Data may be provided directly by the User (by entering information on the Resources, via phone, email, etc.) or obtained from other sources, such as: feedback, comments, information from third parties in the course of dispute resolution, or information from publicly available sources on the Internet.

1.7. The User is prohibited from using the Resources if they do not agree with the terms of this Policy.

2. Data that may be collected and processing technologies

2.1. Personal data of Users, which is received and processed by the Company and Partners, may include:

  • first name, last name;
  • contact phone numbers;
  • email address;
  • region of residence;
  • field of activity;
  • position;
  • CV;
  • portfolio;
  • company name;
  • information necessary for communication between Users of the Resources, including feedback, comments, support requests, complaints, claims, and other inquiries;
  • information about User's activities on the Resources;
  • information provided by Users during participation in events organized by the Company and/or Partners;
  • information received from Users via questionnaires or other forms of interaction with the Resources Administration;
  • information legally obtained from Partners and/or third parties;
  • other contact information provided voluntarily by the User for communication regarding services, notifications, emails, or calls.

2.2. The Company may also process Data using the following technologies:

  • Cookies – small pieces of data that may include an anonymous unique identifier. Cookies are sent to the User's browser from the Resources and stored on the User's device. Tracking technologies also include beacons, tags, and scripts for collecting and tracking information and improving services. Users may refuse all cookies via browser settings. If cookies are disabled, some service functions may be unavailable.
  • Google Analytics – a web analytics service that tracks website and mobile app traffic and may use collected information for advertising and messaging purposes.

3. Purpose of Data Processing

3.1. The Company uses and processes User Data for the following purposes:

  • performing the functions, powers, and duties assigned to the Company in accordance with applicable law, as well as ensuring the implementation of civil, commercial, and tax relations;
  • identifying the User when using the Resources and communicating with the User, including sending email newsletters, phone messages, personal offers, digests, and notifications about news on the Resources, as well as improving service quality, analyzing User activity, keyword search, traffic management on the Resources, and analyzing and forecasting User preferences and interests;
  • conducting analytical activities;
  • sending newsletters, personalized offers, digests, advertising messages, additional service features, and notifications about news on the Resources via email or phone;
  • establishing feedback with the User, including processing inquiries and requests related to the use of the Resources;
  • configuring communication language and ensuring clear understanding of information by the User;
  • providing personalized offers and information aligned with the professional interests and needs of the User;
  • selecting topics and offers considering the sector's specifics and current trends;
  • identifying and correcting service shortcomings and improving User satisfaction with the interaction with the Company;
  • evaluating contractors' compliance, professional skills, potential ability to perform required tasks, as well as assessing their creativity and experience.

4. Conditions of Processing and Transfer to Third Parties

4.1. The processing of Users' personal data is carried out in accordance with applicable personal data legislation.

4.2. To properly fulfill obligations related to service provision, the Company may transfer personal data to third parties, including:

4.2.1. our subcontractors, partners, legal entities, and/or individual entrepreneurs providing services to the Company. Agreements are in place to ensure confidentiality of your personal data.

4.2.2. subcontractors providing technical, payment, or other service-related support. These subcontractors are not authorized to use personal data for purposes unrelated to providing services to the User. Agreements are in place to ensure confidentiality of your data.

4.3. The Company and Partners may transfer or delegate processing of personal data to third parties in the following cases:

4.3.1. transfer is necessary for the User to access the Company's or Partner's services;

4.3.2. to ensure protection of the rights and legitimate interests of the Company or Partner;

4.3.3. in other cases provided by applicable law.

4.4. Resources may contain links to third-party resources. If the User follows such links, they are redirected to third-party resources. The Company recommends reviewing the privacy policy of each third-party resource. The Company does not control and is not responsible for the content, privacy policies, or actions of third-party resources or services.

4.5. The Company does not process data concerning race, nationality, political opinions, religious or other beliefs, membership in public organizations, or information about Users' physiological characteristics that could identify them personally.

5. How to Modify/Delete Data or Withdraw Consent

5.1. Users may unsubscribe from receiving newsletters, news, marketing and promotional offers, digests, etc., at any time by clicking the "Unsubscribe" button in the relevant message.

5.2. If a User has any questions regarding this Policy, they may contact the Company using the contact information provided on the website and receive a response within 30 calendar days.

5.3. To withdraw consent to the processing of personal data, the User may send a request to the following email address: support@fedoriv.com.

5.4. Upon receiving a request to withdraw consent, the User's Data will cease to be processed and will be deleted, except in cases where such processing is required in accordance with applicable Ukrainian law.

5.5. Some functionalities of the Resources that require User information may be limited or disabled from the moment the Data is modified or deleted.

5.6. The Company processes and stores Data for the purposes specified in this Policy for the necessary period, but not longer than 15 (fifteen) years from the date of the User's last interaction with the Resources.

6. Personal Data Protection

6.1. When processing personal data, the Company implements necessary legal, organizational, and technical measures to protect personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, provision, dissemination, and other unlawful actions, in accordance with applicable personal data legislation.

6.2. User personal data is processed on equipment located in secured premises with restricted access.

6.3. The confidentiality of all User personal data is maintained. The Company continuously monitors the measures taken to ensure Data security.

7. User Rights

7.1. To be informed about the sources of Data collection and the purposes of its processing.

7.2. To receive information about the conditions for granting access to personal data, including information about third parties to whom their data may be transferred.

7.3. To access their personal data.

7.4. To submit a justified request to stop the processing of personal data if it is processed unlawfully or is inaccurate.

7.5. To exercise legal remedies in case of violations of personal data protection legislation.

7.6. To withdraw consent to the processing of personal data and the receipt of messages.

8. Changes to the Privacy Policy

8.1. The Company reserves the right to unilaterally amend the terms of this Policy at any time without prior notice to the User. In such a case, the updated version will be published at: https://webcode.agency/privacy-policy. If the User does not agree with the changes, they must immediately cease using the Resources. Continued use of the Resources constitutes the User's acceptance of the updated Policy.

9. Additional Terms

9.1. The Company is not responsible for any damage or loss incurred by the User or third parties due to misunderstanding or misinterpretation of the terms of this Policy.

9.2. If any provisions, sections, or parts of this Policy are found to be inconsistent with applicable personal data laws or invalid, this will not affect the validity of the remaining provisions, which remain fully effective. Any invalid or unenforceable provision is considered amended to the extent necessary to ensure its validity and enforceability.
